西藏自治区登山条例
第一章　总则
Chapter 1 General Principles

第一条　为了发展登山事业，加强对登山活动的管理，促进交流与合作，根据自治区实际情况，制定本条例。
Article 1
This provision is formulated upon the practical experience in ourmunicipality, for the purpose of developing mountaineering, enhancing thesupervision on the activities, so as to promoting communication andcooperation.

第二条　本条例所称登山是指在自治区行政区域内海拔5500米以上的相对独立山峰进行攀登、攀岩、滑雪、滑翔等探险活动。
在自治区行政区域内开展登山活动以及附带在山峰区域内进行科学考察、测绘活动，适用本条例。
Article 2
The “Mountaineering” mentioned in thisprovision refers to the activities as rock climbing, ice climbing, skiing andgliding which performed on the mountains above 5500m altitude.
This provision is also applied to scientific expeditions, surveying andmapping activities conducted on mountain area of in Tibet municipality.

第三条　登山事业应当坚持发挥山峰资源优势，扩大开放和市场化运作，促进、发展登山特色产业的原则。
Article 3
To develop the mountaineering undertaking, we should adhere to theprinciples as putting resource advantage into full play, expanding market aswell as developing mountaineering industry.

第四条　开展登山活动应当尊重当地民族的风俗习惯。
根据当地生态、资源和公共安全的需要，自治区人民政府对有的山峰可以作出禁登规定。
Article 4
Those who perform mountaineering activities should respect the localhistory, culture and social customs.
Concerning about local eco-resource and public security, the government ofTibet municipality reserves the right to forbid any mountaineering activities.

第五条　自治区人民政府应当加强对登山活动的管理，促进登山事业的发展。
自治区人民政府体育行政主管部门及其登山管理机构负责登山活动的管理工作。
自治区登山协会负责登山活动的联络、协调工作。
自治区人民政府相关部门在各自职责范围内，协助开展登山活动。
Article 5
For the purpose of promoting mountaineering undertaking, the municipalitygovernment should enhancing management and supervision of mountaineeringactivities.
The municipality administrative department of physical education (PE) andits related institutions are responsible for the supervision of mountaineering.
The municipality mountaineering association is responsible for the task ofcoordination and contact.
Within the scope of their respective duties, the related departments of themunicipality are supposed to assist mountaineering activities.

第六条　自治区登山管理机构应当每年向山峰所在地的县级人民政府给付20％的登山注册费和60％－80％的登山环保费，并无偿为山峰所在地的居民提供登山服务技能的培训和指导。
县级人民政府应当根据实际情况将部分登山注册费和登山环保费给付乡级人民政府。
Article 6
The mountaineering institution of the municipality is required to pay thelocal county government 20% mountaineering registration fee and 60%-80%
mountaineering environmental protection fee. Furthermore, it shall providefree training and directions on mountaineering skills to the local residents.
According to practical requirement and actual situation, the countygovernment shall deliver part of the registration fee and environmentalprotection fee to the local government of township and village level.

县、乡级人民政府将所收取的登山注册费和环保费应当用于环保和基础设施建设。
The mountaineering registration fee and environmental protection fee shouldbe applied to management and conservation infrastructure of nature reserves.

山峰所在地的县、乡人民政府应当保护当地的生态环境，协助开展登山服务、搞好登山安全、处理登山意外事故。
The government of county and village level shall protect local environment,as well as provide corresponding mountaineering service and handle unexpectedaccident.

第二章　登山活动申请和审批
Chapter 2 Application and Approval Procedures of Mountaineering Expeditions

第七条　登山活动实行申请审批制度。
登山团队应当在开展登山活动30日前向自治区人民政府体育行政主管部门提出登山申请，中外联合登山团队由中方提出申请。
Article 7
The Applicationand Approval Procedures
The mountaineeringteam shall submit mountaineering application to municipality administrativedepartment of physical education (PE) of the local government 10 days beforethe mountaineering expedition. The application of a Chinese & foreign jointmountaineering shall be submitted by Chinese representative.
　　

第八条　自治区人民政府体育行政主管部门在收到登山申请后，应当在20个工作日内作出是否批准的决定，并书面通知申请者。
The municipalityadministrative department of physical education (PE) of the local government isrequired to make a decision within 20 working days after the receipt ofcomplete application materials, and shall notify, in written form, its decisionto the applicant.

第九条　自治区人民政府体育行政主管部门对登山活动中的下列事项向有关部门审批：
Article 9
The municipalityadministrative department of physical education (PE) of the local governmentshall ask for the approval from corresponding department if the activities areto be conducted in mountaineering expeditions.
一、登山附带科学考察的；
1. Scientific Expeditions;
二、登山附带测绘的；
2. Surveying and Mapping;
三、外国影视团组随队拍摄影视资料的；
3. There are foreigners who collect audio-visual materials in themountaineering team.
四、登山团队中有外国议员、官员和记者的；
4. There are foreign councilors, officials and journalists in themountaineering team;
五、在自然保护区内开展登山活动的。
5. Climbing the mountain in natural reserve area.
各有关部门应当积极配合，及时作出书面决定，认真履行法定职责。
All departments concerned shall support and cooperate closely, and performtheir respective duties.
　　

第十条　登山团队应当具备下列条件：
Article 10
A mountaineering team shall meet the following conditions:
（一）登山团队由两人以上组成；
1. There are at least 2 members in a team;
（二）登山计划和安全措施；
2. A complete plan should be drafted, and safety measures should be taken;
（三）登山人员的身体素质和技能；
3. Physical condition and necessary skills for a mountaineer are required;
（四）领队、教练员具有相应的资格证书和登山资历；
4. The leader and coach shall possess corresponding license and practicalmountaineering experience;
（五）聘有登山向导和其他登山协作人员；
5. The mountaineering guide and other assistants shall be employed;
（六）相应的登山活动经费和救援备用经费；
6. The funds for mountaineering and rescuing shall be raised in advance;
（七）保障登山活动的基本技术装备、保暖装备和通讯设备等；
7. Thermal equipment and communication equipment for mountaineering shallbe prepared;
（八）队员人身意外伤害保险；
8. Life accident insurance shall be bought;
（九）生态环境的保护措施。
9. Environmental protection measures shall be taken.

第十一条　登山活动申请应当包括下列内容：
Article 11 The application for mountaineering shall include the following:
（一）所登山峰的名称、海拔高度、地理位置；
1. Name, altitude and location of the peaks to be climbed;
（二）登山时间、路线；
2. Time and route of mountaineering;
（三）队员的姓名、性别、国籍、职业、登山简历、住所及联系方式；
3. Name, gender, nationality, occupation, resume, address and contact infoof all members;
（四）登山物资清单；
4. Goods list
（五）需提供的交通、食宿等服务项目。

第十二条　由国务院体育行政主管部门批准到我区进行登山活动的登山团队，应当到自治区人民政府体育行政主管部门办理登山许可证。
Article 12
The mountaineering team, which approved by the state administrativedepartment of physical culture and sports, shall apply for the license frommunicipality administrative department of physical culture and sports.
　　

第十三条　登山活动申请批准后，登山团队应当在30日内缴纳登山注册费，领取登山许可证。
Article 13
The mountaineering team shall pay registration fee and obtainmountaineering license in 30 days after the approval of mountaineering.
　　

第十四条　登山团队应当按照自治区的有关规定缴纳费用。具体收费项目、标准，由自治区财政、价格主管部门确定。任何单位或个人不得擅自设卡、收取其他费用。
Article 14
Correlative fees shall be paid on time. The detailed charging item,standard shall be regulated by the treasure department of municipalitygovernment. No other organizations and individuals can obstruct mountaineeringor claim for other charges.
　　

第十五条　自治区登山管理部门应当按公布的收费项目和标准为登山团队预算登山活动经费。登山团队应当在开展登山活动30日前，将预算的全部金额汇寄到自治区登山管理部门。
Article 15
The municipality mountaineering department shall make a budget for themountaineering team in accordance with the charging standard published.
　　

第十六条　登山团队应当在规定的期限内实施登山计划，开展登山活动。
登山计划确定后，不得随意变更。因特殊情况需变更的，应当经自治区人民政府体育行政主管部门同意，确认其变更部分或者重新办理登山手续。
Article 16
The mountaineering expeditions shall be implemented within the time fixedin the plan.
No part of the mountaineering plan shall be altered at will once approvedby the relevant department. For reasons of special needs, the plan can bealtered only after the approval of the municipality administrative departmentof physical culture and sports.

第三章　登山活动
Chapter 3 Mountaineering Expeditions


第十七条　登山活动应当遵守下列规定：
Article 17
The mountaineering expeditions shall be conducted under the followingprovisions:
（一）山峰名称和高度以中华人民共和国公布的为准；
1. The names and altitudes of peaks shall be standard ones promulgated byrelevant department of Chinese government.
（二）攀登中外边界山峰时，不得进行有损中国主权和影响与邻国关系的任何活动；
2. Any activities may impair PRC’s nationalsovereignty or jeopardize the relationship between China and its neighborsshall not be conducted in the mountaineering expeditions.
（三）不得转让登山许可证；
The mountaineering license can not be transferred;
（四）需提供超出预算以外的交通、食宿、民工、畜力运输等服务项目的，由随队的联络官办理，登山团队按照有关规定支付费用；
4. The expenses not mentioned in the budget, such as expenses on traffic,accommodations, labor, etc, shall be managed by the liaison official. Theexpenses shall be paid by the mountaineering team in accordance with therelevant provisions.
（五）未经联络官同意，不得擅自解雇中国籍登山协作人员；
The Chinese assistant can’t be dismissed without thepermission from the liaison official;
（六）不得吸收本团队以外的人员参加登山活动；
6. The person who is not the member of the team can’tbe admitted in the mountaineering.
（七）外国团队在登山过程中和在峰顶展现本国国旗时，应当同时展现规格相同的中华人民共和国国旗；
7. If a foreign expedition intends to display a national flag of thecountry the expedition represents， and a nationalflag of similar size of the People's Republic of China shall be displayedsimultaneously.
（八）保持山峰、营地和路线的环境卫生，将登山装备、废旧物品和生活垃圾带回营地，作无害化处理；
8. Climbing routes and camps shall be kept clean. Do not leave any hazardto the environment. Please take any waste materials, life-garbage and discardedequipment back to camping area.
（九）不得在登山区域内擅自安放纪念物和其他物品；
9. The member of a mountaineering team shall not leave any or install anyinstruments on the peak area.
（十）禁止捕杀野生动物、毁坏野生植物，禁止采集植物种子。
10. The mountaineering team shall prohibit hunting wild animals, destroyingvegetation and collecting seeds.
　　

第十八条　自治区人民政府体育行政主管部门指派的联络官应当履行下列职责：
Article 18
The liaison officials shall be designated by the municipalityadministrative department of physical education and their duties are asfollows:
（一）监督登山人员遵守法律、法规；
1. To and supervise mountaineering organizations and individuals incarrying out relevant regulations;
（二）配合实施登山计划；
2. To assist the mountaineering organizations and individuals to conducttheir plan;
（三）组织和管理协作人员，调解各方纠纷；
3. To meditate disputes;
（四）掌握登山进度，核实登顶或登高情况；
4. To confirm the mountain-climbing progress, summit climbing and actualaltitude.
（五）及时协调处理登山事故，并向自治区人民政府体育行政主管部门提交书面事故报告；
5. To make a rapid disposition for emergency and accident, and to reportrelated matters to the municipality administrative department of physicaleducation;
（六）监督登山团队的环保义务履行情况；
6. To supervise the measures taken by the mountaineering team to protectthe environment;
（七）协调处理其他事宜。
7. Handle and meditate other matters.
　　

第十九条　海拔5500米以下山区的环境保护工作由山峰所在地的县、乡人民政府负责；海拔5500米以上山区的环境保护工作由登山组织者负责。
Article 19
Peaks below 5500 meters above sea level, the environmental protectionmeasures shall be taken by the local government of county and village level;Peaks above 5500 meters above sea level, the environmental protection measuresshall be taken by the mountaineering organization.
　　

第二十条　具有登山探险资质的公司依法负责登山团队的接待、服务事宜。登山管理机构和接待组织应当保障登山团队的合法权益。
任何单位和个人不得阻挠、干扰正常的登山活动。
Article 20
The reception service shall be provided by the companies which have thequalification of mountaineering expeditions. The mountaineering managementinstitutions and relevant organization shall protect the legal rights of themountaineering teams and individuals.
No other organizations and individuals can obstruct mountaineeringactivities.
　　

第二十一条　登山活动中发生事故，自治区登山管理机构、登山活动组织者、当地人民政府及其他有关方面应当采取措施积极营救，妥善处理善后事宜。
Article 21
Any accident occurring in the mountaineering expedition shall be properlyhandled without delay, the mountaineering organizations, related governmentdepartment shall mount rescue and deal with problems arising from an accidentpromptly.
　　

第二十二条　自治区登山管理机构应当为登山协作人员办理人身意外伤害保险。登山团队临时雇佣人员在雇佣期间发生人身意外伤害的，参照登山协作人员人身意外伤害保险标准予以补偿。
Article 22
The municipality mountaineering management institute shall makearrangements to provide life accident insurance for the accompanyingassistants. In case of an accidental injury occurs, the assistant shall becompensated in accordance with the insurance standard.
　　

第二十三条　登山协作人员的资质认证和管理办法，由自治区人民政府规定。
Article 23
The approval and management for the qualification of the accompanyingmountaineering assistants shall be regulated by the municipality government.
　　

第二十四条　登山活动结束后，登山团队应当向自治区人民政府体育行政主管部门提交书面报告，经确认后，颁发登顶或登高证明书。
Article 24
Results of the mountaineering expedition shall be reported promptly to themunicipality administrative department of physical education. Once confirmed, alicense of summit climbing will be issued.

第四章　登山附带科学考察、测绘
Chapter 4 Mountaineering Expeditions with Scientific Investigation,Surveying and Mapping

第二十五条　登山附带科学考察或者测绘的，登山团队在向自治区人民政府体育行政主管部门提出登山申请时应当申报科学考察计划或者测绘计划。
Article 25
For mountaineering with concurrent scientific investigation and survey，a plan for such scientific investigation and survey shall be submitted to themunicipality administrative department of physical education.
　　

第二十六条　登山附带科学考察的，登山团队应当通过自治区人民政府体育行政主管部门向自治区人民政府科学技术行政主管部门无偿提供下列样品和资料：
Article 26
For mountaineering with concurrent scientific investigation and survey, themountaineering team shall provide the following items and materials to theadministrative department of science and technology for free:
（一）采集的标本、样品和化石的清单；
1. The list of collected specimens, samples and fossil;
（二）发现的动植物新种或者特殊动植物的类群；
2. Any new species of plants or animals and any special animal or plantgroup;
（三）采集的动植物新种正模式标本、特缺动植物类群的标本；
3. Holo-type specimens of the new species of animals or plants and thespecimens of especially rare of the animals or plants collected；
（四）标本、样品、化石的室内分析结果；
4. The results of laboratory analysis of specimens, samples and fossils;
（五）登山附带科学考察的音像资料复制品；
5. The copies of the audio-visual materials of the concurrent scientificinvestigation or surveying during the mountaineering;
（六）其他需要提供的样品和资料。
6. Other required samples and materials.
　　

第二十七条　登山团队登山时采集的标本、样品、化石以及制作的录像资料，经有关部门检验许可后，方可携带出境。
Article 27
The specimens，samples and fossils collected and theaudio-visual materials produced by a foreign or Chinese-foreign jointexpedition may be taken out of China only after they have been inspected andpermitted by the relevant departments.
　　

第二十八条　登山附带测绘的，登山团队应当通过自治区人民政府体育行政主管部门向自治区测绘部门汇交测绘成果资料。
Article 28
The results of concurrent mapping shall be submitted to the municipalityadministrative department of physical education. And then the results shall beforwarded to the relevant surveying and mapping departments.

第五章 法律责任
Chapter 5 Penalty Provisions

第二十九条　登山团队违反本条例第七条第一款规定，未经批准开展登山活动的，由自治区人民政府体育行政主管部门根据情节轻重，责令停止登山活动，并处以5000元以上30000元以下的罚款。
Article 29
The municipality administrative department of physical education may imposesuch penalties as warning, a fine ranging from 5000 to 30000, or cessation ofthe mountaineering depending on the seriousness of each case on mountaineerswho have violated the stipulations in article 7, that is, who have conductedmountaineering without permission from relevant departments.
　　

第三十条　违反本条例第八条、第十五条规定，不按时批准登山申请、不按规定预算登山活动经费的，由自治区人民政府或其体育行政主管部门给予通报批评，对直接责任人给予行政处分。
Article 31
For those who violated article 8, 15, that is, if the relevant departsfailed to approve application or budget the expenses of the mountaineering, themunicipality administrative department of physical education shall circulate anotice of criticism, or impose administrative punishment on correspondingfunctionary.
　　

第三十一条　登山团队违反本条例第十三条和第十六条规定，不按计划开展登山活动的，所交注册费不退，领取的登山许可证作废，登山计划终止执行。
Article 31
The relevant departments may impose such penalties as cancellation ofmountaineering license, and cessation of the mountaineering plan on those whohave violated the stipulations in article 13, 16, that is, failing to conductmountaineering in accordance with the plan, and the registration fee will notbe refund.
　　

第三十二条　联络官违反本条例第十八条规定，不履行联络官职责的，由其主管部门或者监察机关给予行政处分或者纪律处分。
Article 32
The liaison officials who violated the stipulations in article 18, that is,failing to execute duties and function well, will be imposed on administrativepunishment or discipline punishment.
　　

第三十三条　登山团队违反本条例第二十五条、第二十六条、第二十七条和第二十八条规定的，由自治区人民政府体育行政主管部门根据情节轻重分别给予警告，责令停止登山活动或科学考察、测绘活动，没收采集的标本、样品、化石和制作的资料，并处以10000元以上50000元以下的罚款。
Article 33
For those who violated the stipulations in article 25, 26, 27 and 28, themunicipality administrative department of physical education may impose suchpenalties as a warning, a fine ranging from 10000 to 50000, cessation ofmountaineering, scientific expeditions, surveying and mapping activities, orconfiscation of the collected specimens, samples and fossils depending on theseriousness of each case.
　　

第三十四条　当事人对行政处罚决定不服的，可以依法申请行政复议；对行政复议决定不服的，可以依法提起行政诉讼。当事人在规定的期限内不申请行政复议、不提起行政诉讼，逾期又不履行处罚决定的，作出处罚决定的行政机关可以申请人民法院强制执行。
Article 34
Where a party concerned refuses to accept the administrative penaltydecision, the party may apply for administrative reconsideration of caseaccording to the relevant laws and regulations. Where the party concernedrefuses to accept the reconsideration decision, an administrative lawsuit maybe filed according to the relevant laws of China. Where the party concernedneither applies for reconsideration nor files an administrative law suit withina prescribed time limit, while refusing to comply with the penalty decision onexpiry of the time limit, the administrative department which decided on thepenalty may apply for a compulsory enforcement by the people's court.

第六章　附则
Chapter 6 Supplementary Provisions

第三十五条　本条例自2006年10月1日起施行.1994年5月7日制定的《西藏自治区对外国人来藏登山管理条例》同时废止。
Article 35 This provision shall go into effect as of October 1st, 2006. Onthe day of its promulgation, the “Measures for theadministration of the mountaineering conducted by foreigners in China”, which promulgated on May 7th, 1994, shall be abolished.
